Abstract

 

The article is devoted to an overview of the features of the legal regulation of relations between the Orthodox Church and the state in modern times. The relevance of the issue is due to the fact that relations between the state and the Orthodox Church remain one of the main factors of social stability, legal certainty and democratic progress in Ukraine. The current stage is characterized by significant political, security and socio-cultural challenges, including martial law, transformations of communities and changes in the canonical subordination of religious organizations. The objective of this writing is to investigate the attributes legal structure for the connection between the state and the Orthodox Church in Ukraine across recent years.

The theoretical and judicial perspectives for comprehending state-church relations and their standing within the legal structure are observed. Specifically, the principles of freedom of conscience and belief in legal doctrine, the function of the Orthodox Church among civil society organizations, are assessed. The historical models of interaction between the state and the Orthodox Church are investigated, and their influence on current legal administration is determined. The progressions in the modification of legal governance for interactions between the state and the Orthodox Church in current history are described. The fundamental and lawful standing of the Orthodox Church under the circumstances of a secular state is set. The impact of political and social changes on the character of state-church interactions is examined. Global legal norms and their application in domestic laws are reviewed. Focus is given to the conformity of national legislation with international legal standards concerning religious liberty. Key issues and conflicts in the legal governance of relations between the state and the Orthodox Church at the current phase are identified. Potential avenues for enhancing the legal framework of state-church relationships are justified.
